Terms and Conditions of Sale

Article 1 - Preamble

These Terms and Conditions of Sale govern the contractual relationship between VOGLIO BENE, hereinafter referred to as "the Seller", and any natural or legal person, hereinafter referred to as "the Buyer", wishing to purchase artworks or derivative products offered for sale.

Any order implies unreserved acceptance of these Terms and Conditions.

Article 2 - Products and Artworks

VOGLIO BENE offers for sale:

• Original artworks (paintings, collages, baroque creations)
• Derivative products (posters, textiles, decorative objects)
• Baroque street art creations

The photographs presented on the site are as faithful as possible to the actual works, but may show slight colour variations depending on the screen. Dimensions and technical characteristics are indicated for each product.

Article 3 - Prices

Prices are indicated in euros (€) inclusive of all taxes. The Seller reserves the right to modify prices at any time, it being understood that the price shown on the site on the day of the order will be the only one applicable to the Buyer.

Showroom works: Works displayed in our gallery/showroom are not available for direct online purchase. For any acquisition enquiry, please contact our authorised retailers or contact us directly.

Shipping costs are calculated based on weight, dimensions and destination. They are indicated before final order validation.

Article 4 - Orders

The Buyer places orders online via vogliobeneart.com. Order validation constitutes acceptance of these Terms and Conditions and serves as proof of the sales contract.

The Seller reserves the right to cancel or refuse any order from a Buyer with whom a dispute exists regarding payment of a previous order.

An order confirmation is sent by email to the Buyer after payment validation.

Article 5 - Payment

Payment is made online securely by:

• Bank card (Visa, Mastercard)

The bank card is debited at the time of order validation. In case of payment refusal, the order is automatically cancelled.

Article 6 - Delivery

Delivery times: Delivery times vary depending on the products and destination:

• In-stock products: 3 to 7 working days (metropolitan France)
• Original artworks: 10 to 15 working days (specific packaging required)
• International: 10 to 20 working days depending on destination

France: Colissimo · International: DHL Express

Shipping method: Artworks are shipped with reinforced packaging and appropriate transport insurance. A tracking number is sent by email.

Receipt: The Buyer must check the condition of the parcel in the presence of the delivery person. In case of apparent damage, refuse the parcel or note precise reservations on the delivery slip and contact us within 48 hours.

Article 7 - Right of Withdrawal

In accordance with current regulations, the Buyer has 14 days from receipt of the product to exercise the right of withdrawal without having to justify reasons or pay any penalty.

Exception: Original artworks created to order or personalised cannot be subject to withdrawal (Article L221-28 of the French Consumer Code).

To exercise this right, the Buyer must notify their decision by email to contact@vogliobeneart.com. The product must be returned in its original packaging, in perfect condition, accompanied by the invoice.

The refund will be made within 14 days of receiving the returned product. Return shipping costs are borne by the Buyer.

Article 8 - Warranties

All products sold benefit from the legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

Each original artwork is accompanied by a certificate of authenticity signed by the artist.

Article 9 - Intellectual Property

The Buyer of an artwork acquires material ownership thereof, but the artist retains all copyright (moral rights and economic rights).

Any reproduction, representation or commercial use of the work is strictly prohibited without prior written authorisation from VOGLIO BENE.

Article 10 - Personal Data Protection

Personal data collected during the order process is necessary for processing and delivering the order. It is intended for internal use only.

In accordance with the GDPR, the Buyer has the right to access, rectify and delete their data. To exercise these rights: contact@vogliobeneart.com

Article 11 - Dispute Resolution

In case of a dispute, the Buyer must first contact VOGLIO BENE to seek an amicable solution.

Failing an amicable agreement, the Buyer may resort to consumer mediation.

These Terms and Conditions are governed by French law. In case of unresolved disputes, French courts shall have sole jurisdiction.
